Terms of Service

These Terms of Service ("Terms") govern your use of the RunningBuds app and service ("RunningBuds," the "App"), provided by Codelous, LLC ("we," "us"). Your license to download and use the App from the App Store is granted under Apple's Licensed Application End User License Agreement (the "Standard EULA"); these Terms are in addition to the Standard EULA and govern your use of RunningBuds and its features. If the Standard EULA and these Terms conflict regarding your license to the App, the Standard EULA controls. By using the App, you agree to these Terms; if you do not agree, do not use the App.

1. The App and requirements

RunningBuds provides hands-free, two-person voice communication for running partners. It requires an iPhone running iOS 26 or later, AirPods with Apple's H2 chip, and an internet connection (or a local Personal Hotspot between the two phones) to connect a call.

2. License

Your license to install and use the App is granted under Apple's Standard EULA — a personal, non-transferable license to use the App on Apple-branded devices you own or control, as permitted by the Usage Rules in the Apple Media Services Terms and Conditions. The App is licensed, not sold, and is for personal, non-commercial use only.

3. Subscriptions, trial, and billing

• RunningBuds requires an active free trial or paid subscription to make calls.
• Plans: Monthly — $4.99; Annual — $24.99 (or the local-currency equivalent shown at purchase). A one-time 14-day free trial is available to eligible new subscribers.
• Payment is charged to your Apple ID at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your Apple ID is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription anytime in your Apple ID Account Settings. Deleting the App does not cancel your subscription.
• If you begin a free trial, any unused portion is forfeited when you purchase a subscription, where applicable.
• Prices may change; where required, changes will be communicated and your consent obtained in accordance with Apple's rules and applicable law. Purchases and refunds are handled by Apple under its terms.

4. Relayed connections (fair use)

RunningBuds connects your calls directly between devices whenever possible, and direct connections are unlimited and unmetered. When a direct connection is not available, a call is routed through a relay server, and relayed call time is subject to a fair-use limit of 60 hours per calendar month, per user.

• Relayed time is measured on your device and resets at the start of each calendar month.
• Only time spent on a relayed connection counts toward this limit; directly connected calls never count.
• If you reach the monthly limit, calls that require the relay will be unavailable until the limit resets the following month; calls that can connect directly continue to work normally.
• We may additionally meter, reduce, or suspend relayed usage that we reasonably determine to be abusive or inconsistent with personal, two-person use.

RunningBuds is intended for real-time voice between running partners — not a general-purpose, commercial, or international calling service.

5. Acceptable use

You agree not to: use the App for any unlawful, harassing, or harmful purpose; use it for emergency communications; resell or commercialize the service; or attempt to abuse, overload, reverse-engineer, or circumvent the App's security or relay limits, except where such restriction is prohibited by law.

6. Privacy

Your use of RunningBuds is also governed by our Privacy Policy, which is incorporated into these Terms.

7. Intellectual property

The App, its design, and its content are owned by Codelous, LLC and its licensors and are protected by law. These Terms grant you no rights to our trademarks or branding.

8. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, TO THE MAXIMUM EXTENT PERMITTED BY LAW. Call quality and connectivity depend on your devices, AirPods, and network conditions, which are outside our control. RunningBuds is not intended for emergency communications.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Codelous, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA OR PROFITS. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE APP WILL NOT EXCEED THE AMOUNT YOU PAID FOR IT IN THE 12 MONTHS BEFORE THE CLAIM.

10. Apple App Store

Your license to the App is governed by Apple's Standard EULA. You acknowledge that these Terms are concluded between you and Codelous, LLC — not Apple — and that Apple is not responsible for the App, its content, or any support for it. Apple and its subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.

11. Termination

We may suspend or terminate your license if you breach these Terms (including the relay fair-use limit). Sections that by their nature should survive (e.g., intellectual property, disclaimers, limitation of liability) survive termination.

12. Governing law

These Terms are governed by the laws of the State of Colorado, United States, without regard to conflict-of-laws rules, except where applicable consumer-protection law provides otherwise.

13. Changes

We may update these Terms from time to time. Continued use of the App after an update constitutes acceptance of the revised Terms.
